Terms of Service
These terms cover buying from ATOMBS. They are written to be read. Your rights under Canadian consumer protection law always apply, whatever these terms say.
Who we are
This website and shop are run by [ATOMBS legal business name] ("ATOMBS", "we", "us"), [business address, city, province, postal code]. You can reach us at studio@atombs.example.
Using this site
By using this site or placing an order, you agree to these terms. To buy, you must be the age of majority where you live, or have a parent or guardian's permission. Please give us accurate details so we can reach you and deliver your piece.
One-of-one pieces
Every ATOMBS piece is made once, by hand, usually from reclaimed material. There is only one of each, and once it is sold it is gone.
- We photograph and describe each piece as accurately as we can. Screens show colour differently, so the piece may look slightly different in person.
- Measurements are taken by hand with the piece laid flat and may differ by up to 1 cm.
- Reclaimed materials can carry marks of their earlier life: small holes, fading, mends, or old stitch lines. These are part of the piece, not defects, and we point out anything significant in the description.
Holding a piece
When you claim a piece, we hold it for you for 20 minutes so nobody else can buy it while you sign and pay. A hold is not a purchase. It ends on its own after 20 minutes, or when you release it, and the piece becomes available to others again.
Prices and payment
Prices are in Canadian dollars and include applicable sales taxes. Shipping is included. Payment is processed securely by [payment provider, e.g. Stripe]; we never see or store your full card number.
Your order is accepted when we send you an order confirmation by email. If a piece is listed at a clearly wrong price because of an error, we may cancel the order and refund you in full before it ships.
The Agreement of Singularity
Every piece comes with an Agreement of Singularity. The Maker signs it when the piece is finished, and you sign it at checkout by typing your name and drawing your signature on the contract.
- In it, the Maker promises never to make the piece again, or anything substantially similar to it, in any size, colour or material, for anyone, and to destroy the pattern used to make it.
- The Agreement is a promise made in good faith. As it says, it is not intended to create legal relations: it does not give you or us a legal claim against the other.
- It does not replace or reduce your rights under these terms or under consumer protection law. Your purchase is governed by these terms.
- We keep a copy of the signed Agreement, including your drawn signature, as described in our Privacy Policy. A printed copy is folded inside your parcel.
The Tomb
When a piece is sold, it is entered in the Tomb, a public register on this site showing the piece, the date, the contract number and your initials. We never publish your full name. We keep showing photographs of the piece unless you ask us not to. You can ask us at any time to remove your initials or the photographs.
Shipping, ownership and risk
We ship insured and signed for, at no charge. Ownership of the piece, and responsibility for it, pass to you when it is delivered. Delivery times and details are on our Shipping & Returns page.
Returns and cancellations
You can return a piece within 14 days of delivery, as set out on our Shipping & Returns page. If we do not deliver your piece within 30 days of the delivery date we gave you, you may cancel your order and receive a full refund, as provided by the Consumer Protection Act, 2002 (Ontario) where it applies.
Designs, photos and the ATOMBS name
The designs, patterns, photographs, text and the ATOMBS name and wordmark belong to ATOMBS. Buying a piece gives you the piece itself, not the rights to its design. You are welcome to photograph yourself wearing it and share those photos however you like.
Our responsibility to you
To the extent the law allows, we are not responsible for indirect or unforeseeable losses, and our total responsibility for any order is limited to the price you paid for it. Nothing in these terms limits any responsibility that cannot be limited by law, including your statutory rights as a consumer.
Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one shown on this page when you placed it. The effective date at the top tells you when this page last changed.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If you live elsewhere, you keep any protection that the mandatory consumer laws of your home province or country give you.
